Working together
This agreement is between you, the business ordering the website, and Frontsprout · ABN 88 471 297 764 · Gold Coast, Queensland, Australia. You will work directly with Tim. You confirm that you can authorise this purchase for your business.
Your selected package, payment option and care plan, together with the written scope we agree, set out your project. Your project page keeps the agreement version and payment details you accepted. Changes to the scope, price or timetable need our written agreement before extra work begins.
Your website and feedback
I will build the agreed pages and features, check the website on phones and computers, and ask for your approval before launch. Silence does not count as approval. Your selected package includes:
One feedback round means one consolidated list from your decision-maker within the agreed direction and scope. New pages, features or a new direction after approval need an agreed quote. Fixing my failure to meet the agreed scope does not use up your feedback allowance or limit your legal rights.
- Launch: up to 1 page; 1 feedback round; usual delivery target 5 business days once ready to start. One scrolling page, up to six sections. Mobile layout, click-to-call and one enquiry form. Basic page title, description and local business structured data. Connect one client-owned domain. Keyboard and contrast checks.

What you supply and when we start
You supply accurate business details, approved text, your logo and photographs you have permission to use, the access needed for your domain and other accounts, and approved legal wording. Please choose one decision-maker and check your claims, licences, contact details and prices before publication. Your approval does not remove my responsibility for my work.
We agree a start date once the scope, required content, access and first payment are ready. Waiting for your content, access or feedback pauses the delivery target; I will explain any revised date. If I expect a delay, I will tell you and agree a practical response. Use delegated account access: do not put passwords or sensitive customer records in the brief or ordinary email.
- Outside the standard build: Online shop and payment processing.
- Outside the standard build: Custom booking system, database or login.
- Outside the standard build: Logo design and photography.
- Outside the standard build: Copywriting beyond light formatting of supplied text.
- Outside the standard build: Ongoing SEO campaigns.

All amounts are AUD. AUD. GST is not charged. No extra card surcharge is added. Any external purchases need your approval first.
The booking payment is 50% of the build price, rounded up to a whole dollar. You pay the rest after approving the website and before launch. Your chosen monthly care starts at launch and is billed in advance.
- Launch: $999 for the build, with $500 to book and $499 before launch. Your chosen care is additional.

Spread the build, then pay care only
The first combined monthly payment books your project and counts as payment one of your selected term. It includes the build instalment and your chosen care plan, with pre-launch support and setup. There is no separate deposit and no second care charge at launch. Later payments fall on monthly anniversaries.
Spreading costs more than paying the two-part cash build price. The build price and care price stay fixed during your chosen build term. Once its scheduled build payments are paid, the monthly amount automatically drops to your selected care price. Your checkout summary and project page show your selected payments and minimum total. An agreed promotion is shown in Stripe before you pay.

Hosting and care
Support hours: Monday-Friday 9 am-5 pm AEST, excluding Queensland public holidays. A response target means acknowledgement and a plan, rather than a promise that every issue will be resolved in that time. Unused content time does not roll over. Extra work needs an agreed quote.
Deployment backups cover the website's code and content, not external booking databases or email accounts unless separately agreed. Hosting is for the agreed lawful business website. We will discuss and agree substantial usage or feature changes before charging for them.
- Essential: $79 a month, 1-month minimum care term and 30 days' written notice to end. Response target: 2 business days. Managed hosting, SSL and deployment backups. Monthly form/link check and dependency/security review. Fix defects introduced by agency work.

Quarterly 30-minute review and one prioritised improvement within the included time.

Your first design direction
A clear direction before the full build. At the first design presentation, before approval to build the remaining pages.
One alternative homepage direction within the signed brief. If it still does not fit, the client may stop: refund the build deposit or build instalments already paid, cancel unpaid build instalments and refund unused prepaid care.
Tell Tim within 5 business days of the first design presentation, before approving the direction or asking for the remaining build. Client must decide before approving the direction or requesting the remaining site build. Separately approved third-party purchases are excluded only where lawful and clearly disclosed.
This voluntary promise is in addition to rights and remedies under Australian Consumer Law and does not limit them. No guarantee of rankings, sales, leads or uninterrupted third-party services.
Ending care or settling early
You can end monthly care with 30 days' written notice to the agreed paid-through date. I will confirm the exit date and handover. Ending care does not itself cancel an unpaid build obligation.
For a completed, accepted spread build, early settlement is the remaining cash build price after the principal portions of cleared instalments, plus only undisputed care and extra spread charges already earned but unpaid. The principal is the portion paying off the ordinary cash build price. The remaining cash balance is rounded down to a whole dollar in your favour. We never charge the same unpaid principal twice. Future extra spread charges and care after the agreed exit date are waived.
Pay the remaining cash build balance and any undisputed earned amounts; agency transfers the agreed custom files within 10 business days. Care can continue or end.
If the client declines to settle the remaining build balance, permission to use unpaid agency work ends and the site may be taken offline after notice. The unpaid cash build balance remains due; shutdown is not a debt waiver. No future care or unearned premium is charged after the agreed exit date.
Before launch: Pay only reasonable documented work performed and approved non-refundable external costs up to the cash build price; refund unused money. Never charge the full unperformed project by default. The design-direction promise and your legal rights may provide a better remedy.
For overdue payments: Written reminder and at least 14 days to remedy before suspension; explain the amount and dispute path. Preserve client domain, email, supplied content and export access. Do not suspend for a genuinely disputed amount without reviewing it. Contact me early if you need a practical payment arrangement. No automatic late fee applies.
What belongs to you
Client registers and owns the domain from day one; agency only receives delegated access.
Client keeps ownership of supplied text, photos, logo and customer data at all times.
Agreed custom design and source files transfer after cash build price and earned charges are fully settled. Until then the client receives a licence to use the hosted site while payments are current.
Agency retains reusable starter code, tools and generic components; client receives a perpetual licence to included reusable components on full settlement.
Fonts, stock images, integrations and open-source software stay subject to their licences; subscriptions remain with the client.
One standard source/content export and transfer guide included after settlement; migration labour beyond the included handover is quoted.
Your information and private project page
I use your business and contact details to deliver the project, manage payments and send service emails. Stripe processes payments and holds payment-card details; I never see or store those card details. Service emails are sent through Google's Gmail. The privacy policy explains storage, access, retention and your rights.
Your private project link gives access to your project details and actions without a password. Keep it private and share it only with people authorised to manage your project. Contact me if you believe someone else has the link. We record the agreement version, acceptance time, IP address and browser to keep a record of your acceptance.
Each party will protect the other's confidential information and share it only with authorised providers who need it for this work. I will tell you promptly about a suspected security incident affecting information I handle for your project.
Your rights and resolving problems
I will provide the services with due care and skill. Nothing in this agreement excludes, restricts or changes rights or remedies that cannot lawfully be excluded, including Australian Consumer Law rights. Being a business does not automatically remove those protections. Any voluntary guarantee is additional to them.
If the law gives you a cooling-off period, you can cancel within it by contacting Tim.
Raise a concern promptly and we will work in good faith to resolve it. This does not prevent a regulator complaint, urgent relief or a remedy available by law. Changes to this agreement need our written agreement. Queensland and applicable Australian law govern it, subject to mandatory consumer rights and jurisdiction rules.
